Terms of Service

These Terms of Service ("Terms") govern your access to and use of the High² platform, websites, and related tools operated by HighSquared.com ("High²," "we," "us," or "our"). By creating an account, subscribing, or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service.

1. What High² is — and is not

High² is an independently operated software and marketing platform that provides an interactive presentation experience, prospecting tools, and analytics for use by independent members of At Cost Metals. High² is not owned by, endorsed by, or officially affiliated with At Cost Metals, LLC. High² does not sell precious metals, does not provide investment, financial, or tax advice, and does not administer any affiliate compensation. Any earnings you receive as an At Cost Metals member are governed solely by the official At Cost Metals program, not by High².

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use High². You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Subscriptions, billing, and trials

High² is offered on a paid subscription basis, with any free-trial terms stated at signup. By subscribing you authorize us and our payment processor to charge the applicable recurring fee to your payment method until you cancel. Subscriptions renew automatically for successive periods unless cancelled before the renewal date. You may cancel at any time; cancellation stops future charges and takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. We may change pricing on prospective notice.

4. Acceptable use and compliance

High² is built to support honest, compliant, education-first outreach. You agree that you will not use the platform to:

• make income, earnings, or lifestyle claims that are guaranteed, typical, or misleading, or that conflict with the official At Cost Metals income disclosure;
• provide investment, financial, or tax advice, or represent precious metals as risk-free or guaranteed to appreciate;
• misrepresent your relationship with At Cost Metals or High², or impersonate either entity;
• send unsolicited bulk or automated communications, or contact people using purchased, scraped, or non-consented contact lists;
• violate any applicable law, the official At Cost Metals policies, or third-party rights, including trademark and privacy rights.

You are solely responsible for your own communications and conduct. High²'s compliance tooling is a safeguard, not a guarantee of legal compliance, and does not substitute for your own judgment or professional advice.

5. Prospect data and your responsibilities

When you use High² to engage prospects, you are responsible for having a lawful basis to contact those individuals and for honoring their choices, including opt-out requests. You agree not to upload or process personal information about others without an appropriate basis to do so, and to comply with all applicable marketing, privacy, and consumer-protection laws. Our handling of data is described in our Privacy Policy.

6. Intellectual property

High², the AI² Connect experience, Prospect Intelligence™, and all associated software, designs, and content are owned by HighSquared.com or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the platform for its intended purpose while your subscription is active. All third-party names, logos, and brands — including At Cost Metals — remain the property of their respective owners, and nothing here grants you rights in them.

7. Third-party services

The platform relies on third-party services (for example, payment processing, hosting, and communications providers). Your use of those services may be subject to their own terms, and we are not responsible for their acts or omissions.

8. Disclaimers

The platform is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or that any particular business, sales, or income outcome will result from its use. No income is guaranteed and results vary based on individual effort, skill, and circumstances.

9. Limitation of liability

To the fullest extent permitted by law, High² and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the platform. Our total liability for any claim relating to the platform will not exceed the amount you paid to High² in the twelve months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless High² from claims, damages, and expenses (including reasonable legal fees) arising from your use of the platform, your communications with prospects, or your breach of these Terms or applicable law.

11. Suspension and termination

We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or fail to pay. You may stop using the platform and cancel at any time. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the platform or by email, and your continued use after the effective date constitutes acceptance.

13. Governing law and disputes

These Terms will be governed by the laws of the state in which HighSquared.com is organized, without regard to conflict-of-law principles.
